Terms & conditions

These Terms and Conditions ("Agreement") govern the use of services provided by Train.Move.Motivate. ("we," "our," or "us"). By purchasing or utilizing any of our services, you ("Client") agree to comply with and be bound by these Terms and Conditions.

1. Pricing and Packages

A. Session Pricing
We offer the following pricing options for individual sessions and class packages:

  • First Session Free: The first session is complimentary for new clients.

  • Single Session: $25 per session.

  • 5-Class Package: $120.

  • 10-Class Package: $230.

  • 20-Class Package: $420.

B. Membership Options
Our membership options are designed to accommodate varying levels of participation. The following memberships are available:

  • 1x per week: $95/month.

  • 2x per week: $150/month.

  • Unlimited Classes: $200/month (ideal for highly active participants).

C. Pricing Changes
We reserve the right to change pricing at any time, at our sole discretion. However, clients who have already purchased a package or membership will not be subject to a price change until the next billing cycle or class package is purchased.

2. Payment Terms

  • All sessions must be paid for in advance unless otherwise agreed upon.

  • For membership subscriptions, payment is due at the beginning of each billing cycle, and the payment will automatically renew until canceled.

  • Memberships are non-refundable for the current cycle; however, clients can cancel for the following cycle.

  • In the event that a client cancels their membership in the middle of a billing cycle, the client will not be charged for the following billing cycle, but no refunds will be provided for the current cycle.

3. Cancellations and Rescheduling

A. Session Cancellations by Client

  • Clients must provide at least 24 hours' notice to cancel or reschedule a session without incurring a fee.

  • If a session is canceled with less than 24 hours' notice, the full session fee will be charged.

B. Session Cancellations by Train.Move.Motivate.

  • In the event that a session must be canceled by us (e.g., due to illness, scheduling conflicts, etc.), we will make every effort to notify the client as soon as possible and reschedule the session at a mutually convenient time.

  • We reserve the right to reschedule or cancel sessions due to unforeseen circumstances, including but not limited to severe weather, facility issues, or other emergencies.

4. Weather-Related Cancellations

  • In the event of weather conditions that make it unsafe to hold a session (e.g., heavy rain, snow, or other extreme weather events), we may cancel or reschedule the session.

  • We will notify clients as early as possible, and clients will not be charged for sessions that are canceled due to weather-related events.

  • If the weather changes unexpectedly after a session has begun, we will make reasonable efforts to complete the session, but we reserve the right to cancel if safety becomes a concern. If the session is cut short due to weather, clients will be given a partial credit or rescheduled at no additional cost.

5. Liability Waiver and Assumption of Risk

  • By participating in fitness classes or personal training sessions, clients acknowledge that they are voluntarily participating and assume all risks associated with the activities.

  • Clients are encouraged to consult with their physician before beginning any fitness program, especially if they have any pre-existing medical conditions or concerns.

  • By agreeing to these Terms and Conditions, clients release Train.Move.Motivate and its instructors from any liability, claims, or injuries that may arise during or after their participation in fitness services.

6. Client Conduct

  • Clients agree to behave in a respectful and safe manner during all sessions. Any form of disruptive, abusive, or unsafe behavior will not be tolerated.

  • Train.Move.Motivate. reserves the right to terminate services with any client who exhibits behavior that jeopardizes the safety or well-being of other participants, the instructor, or the business.

7. Changes to Services and Pricing

  • Train.Move.Motivate. reserves the right to modify, suspend, or discontinue any services, sessions, or membership plans at any time, with or without notice. Any changes to pricing, packages, or services will be communicated to clients prior to their next billing cycle.

8. Termination and Suspension

  • Clients may cancel their membership at any time. Cancellations will take effect at the end of the current billing cycle, and no further payments will be charged after cancellation.

  • Train.Move.Motivate. reserves the right to suspend or terminate any client’s membership for violations of these Terms and Conditions or for non-payment.

9. Confidentiality and Privacy

  • All personal information collected from clients is kept confidential and will not be shared with third parties without the client’s consent, except as required by law or as necessary for business operations (e.g., payment processors).

  • Clients have the right to request access to their personal data or request its removal, subject to applicable laws.

10. Dispute Resolution

  • In the event of any dispute arising out of these Terms and Conditions, both parties agree to first attempt to resolve the issue informally. If resolution is not achieved, the dispute will be resolved through binding arbitration in accordance with the laws of Florida, USA.

By purchasing and/or participating in our services, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this document.
